ASML: We gaan in Hoger Beroep (English version below)

Zoals jullie weten, zit deze procedure op twee zaken:

1. de vakbondscontributie en
2. de te late betaling volgend uit zowel het principeakkoord als de cao Metalektro.

Zoals jullie ongetwijfeld hebben meegekregen, heeft de kantonrechter een vonnis uitgesproken dat ons in verwarring en ontzetting achterlaat. We hebben het vonnis inmiddels goed bestudeerd en zijn van mening dat we voldoende aanknopingspunten hebben om het vonnis van de kantonrechter in hoger beroep aan te vechten.

In Nederland bestaat er een hiërarchie binnen het rechtsprekende systeem. Een zaak wordt eerst voorgelegd aan de rechtbank. Indien men het niet eens is met de uitspraak van de rechtbank, kan men in hoger beroep gaan bij het gerechtshof. In sommige gevallen kan de Hoge Raad (cassatie) daarna nog gevraagd worden zich over de zaak te buigen. Ook de wederpartij heeft de mogelijkheid om in hoger beroep te gaan.

Uiteraard houden we jullie op de hoogte van die ontwikkelingen.

We will appeal!

On March 2, 2023, the District Court East Brabant ruled in the case between Trade Unions FNV/CNV and ASML Netherlands. As you are aware, this procedure involves two matters: 1) union membership fees, and 2) delayed payment arising from the both the collective labor agreement (CAO Metalektro) and the agreement in principle.

Undoubtedly, you have heard that the court delivered a verdict that has left us confused and dismayed. We have thoroughly examined the verdict and believe that we have sufficient grounds to challenge it by filing an appeal.

In the Netherlands, there is a hierarchical structure within the judicial system. A case is initially presented to the court. If a party disagrees with the court's ruling, they can file an appeal to the court of appeal. In certain cases, the Supreme Court can be the final instance. The opposing party also has the option to appeal.
